Terms & Conditions
Definitions
"Facility" means [Company Name], its employees, agents, and representatives.
"Customer" means the person or entity renting a storage unit.
"Unit" means the storage space assigned to the Customer.
Rental of Storage Unit
The Facility agrees to provide the Customer with a storage unit for the storage of lawful personal or business property, subject to these Terms and Conditions.
Rental Term
The Agreement begins on the date specified in the Rental Agreement.
The rental shall continue on a monthly basis until terminated by either party.
Either party may terminate the Agreement upon 30 days' written notice unless otherwise specified.
Payment
Rent is payable in advance on or before the due date.
The Facility may charge late payment fees for overdue accounts.
Failure to pay rent when due constitutes a default under this Agreement.
The Facility reserves the right to revise rental rates upon providing at least 30 days' notice.
Security Deposit
A refundable security deposit may be required.
The deposit may be applied toward unpaid rent, damage to the Unit, cleaning costs, lock removal fees, or other outstanding charges.
Any remaining balance will be returned within 30 days after termination, subject to inspection.
Permitted Storage
The Customer may store only lawful property.
The following items are strictly prohibited:
Illegal goods or contraband. Explosives, ammunition, fireworks, or highly flammable materials. Hazardous chemicals, toxic substances, or pollutants. Perishable food likely to spoil or attract pests. Living animals, plants, or persons. Stolen property. Any item prohibited by Thai law.
Customer Responsibilities
The Customer shall:
Maintain the Unit in a clean and sanitary condition. Secure the Unit with an approved lock. Keep contact information current. Promptly report any suspected security incidents. Comply with all Facility rules and regulations.
Access to the Facility
Access is permitted only during posted operating hours unless otherwise authorized.
The Facility may change access hours with reasonable notice.
The Facility may suspend access where rent remains unpaid or where safety concerns exist.
Insurance and Risk of Loss
The Facility does not insure the Customer's property.
All property is stored at the Customer's sole risk.
The Customer is encouraged to obtain insurance covering theft, fire, water damage, flood, and other risks.
The Facility makes no representation regarding the suitability of the Unit for any particular property.
Limitation of Liability
To the fullest extent permitted by law, the Facility shall not be liable for loss or damage caused by theft, burglary, fire, flood, storm, pests, mold, humidity, power outages, or events beyond its reasonable control.
The Facility shall not be responsible for consequential, indirect, or business losses.
Nothing in this Agreement excludes liability that cannot legally be excluded under applicable law.
CCTV and Security
CCTV may operate within common areas of the Facility.
CCTV is provided for general security purposes only.
The Facility does not guarantee prevention of theft, loss, or damage.
Customers acknowledge that CCTV monitoring does not constitute an insurance service.
Facility Right of Entry
The Facility may enter the Unit in emergencies, to prevent injury or property damage, when required by law, or upon reasonable notice where inspection is necessary to investigate suspected violations of this Agreement.
Where reasonably possible, the Facility will attempt to contact the Customer before entry.
Default
A Customer is in default if rent remains unpaid after the applicable grace period, the Customer breaches these Terms and Conditions, or the Unit is used for unlawful purposes.
Upon default, the Facility may suspend access, apply deposits against outstanding amounts, pursue recovery of unpaid charges through lawful means, and exercise any rights available under applicable Thai law.
Abandoned Property
Where a Customer fails to remove property after termination or fails to respond to reasonable contact attempts regarding overdue accounts, the Facility may treat the property as abandoned to the extent permitted by applicable law.
The Facility may remove, store, dispose of, or otherwise deal with abandoned property in accordance with legal requirements.
The Customer remains liable for outstanding charges and costs incurred.
Indemnity
The Customer agrees to indemnify and hold harmless the Facility from claims, losses, liabilities, damages, and expenses arising from the Customer's use of the Unit, stored property, breach of this Agreement, or violation of applicable laws.
This does not apply where losses are caused by the Facility's gross negligence or willful misconduct.
Personal Data (PDPA Consent)
The Customer acknowledges that the Facility may collect, use, and store personal information including name, address, telephone number, email address, identification documents, and CCTV recordings.
Such information may be used for account administration, security purposes, payment collection, legal compliance, and customer communications.
The Facility will process personal data in accordance with Thailand's Personal Data Protection Act (PDPA) and applicable privacy laws.
Force Majeure
The Facility shall not be liable for delays or failure to perform obligations caused by events beyond its reasonable control, including natural disasters, government actions, civil disturbances, pandemics, utility failures, or similar events.
Governing Law
This Agreement shall be governed by the laws of the Kingdom of Thailand.
Dispute Resolution
The parties shall first attempt to resolve disputes through good-faith negotiation.
If resolution cannot be achieved, disputes shall be submitted to the competent courts of Thailand.
Entire Agreement
These Terms and Conditions, together with the Rental Agreement and Facility Rules, constitute the entire agreement between the parties.
